Terms of Service
Scope
These terms govern your use of this website and the services Esencia provides. Esencia is a services firm, not a software product. Specific service engagements are governed by a separate written Statement of Work.
Deliverables and ownership
On payment in full, all deliverables produced for you under a Statement of Work are owned by you. Esencia retains ownership of generic methodologies, templates, and tools it brought to the engagement.
Confidentiality
Each engagement is governed by mutual confidentiality. Neither party will disclose the other party's confidential information without written consent.
Limitation of liability
To the maximum extent permitted by law, Esencia's total liability under any engagement is limited to the fees paid for the engagement in question. Esencia is not liable for indirect, consequential, or incidental damages.
Governing law
These terms are governed by the laws of the State of Israel. For clients with their principal place of business in the United States or Canada, any dispute may, at the client's election, be brought in a court of competent jurisdiction in that client's home state or province.
